By accessing or using the Firmyx platform (“Service”), you confirm that you have read, understood, and agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you may not use the Service.

You must be at least 18 years old, or have the legal authority to enter into binding contracts on behalf of a legal entity, to use this Service.

2. Description of Service

Firmyx is an AI-powered financial analytics and business intelligence platform. The Service includes, but is not limited to: financial health indicators, risk assessment indicators, insolvency probability indicators, trend analysis, and automatically generated analytical insights.

No professional advice: All outputs from the Service are for informational purposes only. Firmyx does not provide financial, investment, accounting, tax, or legal advice. Nothing in the Service constitutes a recommendation to buy, sell, hold, or otherwise deal in any financial instrument, or to take any specific financial, legal, tax, or accounting action.

No guarantee of accuracy: Scores, forecasts, and insights generated by the Service are model-based estimates. Accuracy varies depending on the quality, completeness, and timeliness of the data you upload. Results may be incomplete or inaccurate. You are responsible for verifying any output before relying on it.

User responsibility: You are solely responsible for any business decisions made on the basis of information provided by the Service. We recommend consulting qualified financial, accounting, tax, or legal professionals for advice specific to your situation.

3. Account Registration

• You are responsible for maintaining the security of your account and password.
• Notify us immediately of any unauthorized access to your account.
• Accounts may not be transferred to third parties.

4. Free Plan, Payments & Refunds

The free plan provides access to core features with no credit card required. Paid plans (when available) are billed monthly or annually in advance. You may cancel your subscription at any time with no cancellation fees; your access continues until the end of the current billing period.

5. Data Quality & User Obligations

You acknowledge and agree that:

• You will not upload intentionally false, misleading, or fabricated financial information.
• Firmyx bears no responsibility for inaccurate outputs resulting from inaccurate or incomplete input data.
• Scores and forecasts are model-based estimates and may be incomplete or inaccurate depending on the quality of uploaded data.

6. Acceptable Use

You may not:

• Use the Service for any unlawful purpose.
• Attempt to circumvent or bypass system limitations.
• Share or sell access to your account.
• Reverse-engineer, scrape, or extract data from the platform.

7. Data & Privacy

We process your personal data in accordance with our Privacy Policy. Your financial data is encrypted with AES-256 encryption and is never shared with third parties for commercial purposes.

You may request deletion of your account and all uploaded financial data at any time by emailing atanas.k.kanev@gmail.com.

8. Intellectual Property

All rights to the platform, algorithms, and design belong to Firmyx. Users retain full rights over the data they upload.

9. Disclaimer of Warranties

Firmyx provides the Service on an “as-is” and “as-available” basis. The platform is not a licensed financial advisor, accountant, tax advisor, or legal counsel and is not a substitute for professional services. Firmyx makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any analytical output. Forecasts and scores are estimates only — they are not guarantees of future results.

Users are encouraged to discuss any significant financial observations with a qualified financial professional before making decisions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Firmyx and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from or in connection with use of the Service, even if advised of the possibility of such damages.

Firmyx's total liability to you for any claim arising from these Terms or the Service shall not exceed the amount paid by you to Firmyx in the twelve (12) months preceding the claim.

11. Termination

You may close your account at any time. Firmyx reserves the right to suspend or terminate access for violations of these Terms, with or without prior notice depending on the severity of the violation.

12. Changes to Terms

We will notify users by email at least 14 days before significant changes to these Terms take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Bulgaria and applicable European Union law.
